Privacy Policy

We are pleased about your interest in our online magazine. The protection of your privacy is very important to us. Below we inform you in detail about how we handle your data.

1. Access data and hosting

You can visit our websites without providing any personal information. Each time a web page is accessed, the web server automatically saves a so-called server log file, which contains, for example, the name of the requested file, your IP address, the date and time of the call, the amount of data transferred, and the requesting provider (access data) and documents the call.

These access data are evaluated exclusively for the purpose of ensuring the trouble-free operation of the site and improving our services. This serves, in accordance with Art. 6 para. 1 sentence 1 lit. f GDPR, to safeguard our predominant legitimate interests in a correct representation of our offer in the context of a balance of interests. All access data will be deleted at the latest seven days after the end of your page visit.

Hosting services by a third party

As part of a processing in our order, a third party provides us with the services for hosting and display of the website. This serves to safeguard our predominant legitimate interests in a correct representation of our offer in the context of a balance of interests. All data collected as part of the use of this website or in forms provided for this purpose in the online shop are processed on their servers. Processing on other servers only takes place within the framework explained here.

This service provider is located within a country of the European Union or the European Economic Area.

2. Data collection and use for contract processing and when opening a customer account

We collect personal data when you provide this to us voluntarily in the context of your order, when contacting us (e.g. via contact form or e-mail), or when opening a customer account. Mandatory fields are marked as such, as we need this data for the contract processing or for handling your contact request or the opening of the customer account, and you cannot complete the order and/or the account opening without providing this information.

What data is collected can be seen from the respective input forms. We use the data you provide in accordance with Art. 6 para. 1 sentence 1 lit. b GDPR for contract processing and handling your inquiries.

After complete processing of the contract or deletion of your customer account, your data will be restricted for further processing and deleted after expiration of the tax and commercial retention periods, unless you have expressly consented to further use of your data or we reserve further use of data that is legally permitted and you are informed about this in this declaration.

The deletion of your customer account is possible at any time and can be carried out either by sending a message to the contact option described below or via a function provided for this purpose in the customer account.

3. Data transfer

In order to fulfill the contract in accordance with Art. 6 para. 1 sentence 1 lit. b GDPR, we pass on your data to the shipping company commissioned with the delivery as far as this is necessary for the delivery of the ordered goods.

Depending on which payment service provider you select in the order process, we will transmit the payment data collected for this purpose to the credit institution commissioned with the payment and, if applicable, to the payment service providers commissioned by us or to the selected payment service.

Part of the selected payment service providers also collects this data themselves, as far as you create an account there. In this case, you must log in to the payment service provider with your credentials during the order process.

The privacy policy of the respective payment service provider applies in this respect.

Data transfer to shipping service providers

If you have expressly consented to us during or after your order, we will forward your phone number to the selected shipping service provider on this basis in accordance with Art. 6 para. 1 sentence 1 lit. a GDPR, so that they can contact you before delivery for the purpose of delivery notification or coordination.

Consent can be revoked at any time by sending a message to the contact option described below or directly to the shipping service provider at the contact address provided below.

After revocation, we will delete your data provided for this purpose, unless you have expressly consented to further use of your data or we reserve further use of data that is legally permitted and you are informed about this in this declaration.

4. E-mail newsletters and postal advertising

Email advertising with newsletter registration

When you register for our newsletter, we use the necessary or separately provided data to send you our e-mail newsletter regularly based on your consent in accordance with Art. 6 para. 1 sentence 1 lit. a GDPR.

Unsubscribing from the newsletter is possible at any time and can be done either by sending a message to the contact option described below or via a link provided for this purpose in the newsletter.

After unsubscribing, we will delete your email address unless you have expressly consented to further use of your data or we reserve further use of data that is legally permitted and you are informed about this in this declaration.

Email advertising without newsletter registration and your right to object

If we receive your email address in connection with the sale of a product or service and you have not objected to this, we reserve the right to regularly send you offers for similar products, like those you have already purchased, from our range via email based on § 7 para. 3 UWG. This serves to safeguard our predominant legitimate interests in a promotional approach to our customers in the context of a balance of interests.

You can object to this use of your email address at any time by sending a message to the contact option described below or via a link provided for this purpose in the promotional email, without incurring any costs other than the transmission costs according to the basic tariffs.

The newsletter is sent as part of a processing on our behalf by Infusion Software, Inc. (www.infusionsoft.com), to which we pass on your email address for this purpose.

Infusion Software, Inc. is based in the USA and is certified under the EU-US Privacy Shield. A current certificate can be viewed here . Due to this agreement between the USA and the European Commission, the latter has established an adequate level of data protection for companies certified under the Privacy Shield.

Postal advertising and your right to object

Furthermore, we reserve the right to use your first and last name as well as your postal address for our own advertising purposes, e.g. to send interesting offers and information about our products by mail. This serves to safeguard our predominant legitimate interests in a promotional approach to our customers in accordance with Art. 6 para. 1 sentence 1 lit. f GDPR.

5. Cookies and web analysis

In order to make the visit to our website attractive and to enable the use of certain features, to display suitable products or for market research, we use so-called cookies on various pages. This serves to safeguard our predominant legitimate interests in an optimized representation of our offer in accordance with Art. 6 para. 1 sentence 1 lit. f GDPR.

Cookies are small text files that are automatically stored on your end device. Some of the cookies we use are deleted after the end of the browser session, i.e. after closing your browser (so-called session cookies).

Other cookies remain on your end device and enable us to recognize your browser the next time you visit (persistent cookies). You can find out the duration of storage in the overview of your browser's cookie settings. You can set your browser to inform you about the setting of cookies and to decide individually on their acceptance or to exclude the acceptance of cookies for certain cases or in general. Each browser differs in the manner in which it manages cookie settings.

This is described in the help menu of each browser, which explains how you can change your cookie settings. You can find it for the respective browsers at the following links:

If cookies are not accepted, the functionality of our website may be limited.

Use of Google (Universal) Analytics for web analysis

If you have given your consent in accordance with Art. 6 para. 1 sentence 1 lit. a GDPR (cookie consent functionality active on our website from 25.05.2018), this website uses Google (Universal) Analytics for the purpose of web analysis, a web analysis service of Google LLC (www.google.de). Google (Universal) Analytics uses methods that enable analysis of the use of the website by you, such as cookies. The automatically collected information about your use of this website is usually transmitted to a Google server in the USA and stored there.

By activating IP anonymization on this website, the IP address is shortened before transmission within the member states of the European Union or in other contracting states of the agreement on the European Economic Area.

Only in exceptional cases will the full IP address be transmitted to a server of Google in the USA and there shortened. The anonymized IP address transmitted by your browser in the context of Google Analytics will not generally be merged with other data from Google. After the purpose has been achieved and the use of Google Analytics has ended, the data collected in this context will be deleted.

Google LLC is based in the USA and is certified under the EU-US Privacy Shield. A current certificate can be viewed here . Due to this agreement between the USA and the European Commission, the latter has established an adequate level of data protection for companies certified under the Privacy Shield.

You can revoke your consent at any time with effect for the future by downloading and installing the browser plugin available under the following link: http://tools.google.com/dlpage/gaoptout?hl=en

This prevents the collection of data generated by the cookie and related to your use of the website (including your IP address) as well as the processing of this data by Google.

Alternatively, you can click this link to prevent the collection by Google Analytics on this website in the future. In this case, an opt-out cookie will be stored on your end device. If you delete your cookies, you will be asked again for your consent.

6. Advertising via marketing networks

Google AdWords Remarketing

Through Google Adwords, we advertise for this website in Google search results as well as on third-party websites. If you have given us your consent in accordance with Art. 6 para. 1 sentence 1 lit. a GDPR (cookie consent functionality active on our website from 25.05.2018), when visiting our website, the so-called remarketing cookie from Google is set, which automatically enables interest-based advertising using a pseudonymous cookie ID and based on the pages you visited. After the purpose has been achieved and the use of Google AdWords Remarketing has ended, the data collected in this context will be deleted.

Further data processing only takes place if you have consented to Google linking your web and app browser history with your Google account and using information from your Google account to personalize ads you see on the web.

If you are logged into Google during your visit to our website in this case, Google uses your data together with Google Analytics data to create and define audience lists for cross-device remarketing. For this purpose, your personal data is temporarily linked by Google with Google Analytics data to form audiences.

Google AdWords Remarketing is an offer of Google LLC (www.google.de). Google LLC is based in the USA and is certified under the EU-US Privacy Shield. A current certificate can be viewed here . Due to this agreement between the USA and the European Commission, the latter has established an adequate level of data protection for companies certified under the Privacy Shield.

You can revoke your consent at any time with effect for the future by deactivating the remarketing cookie via this link . You can also find information about setting cookies and make settings with the Digital Advertising Alliance .

7. Social media plug-ins

Use of social plugins from Facebook, Instagram

On our website, so-called social plugins (“plugins”) from social networks are used. When you visit a page of our online presence that contains such a plugin, your browser establishes a direct connection to the servers of Facebook, Google, Twitter or Instagram.

The content of the plugin is transmitted directly by the respective provider to your browser and integrated into the page. By embedding the plugins, the providers receive the information that your browser has accessed the corresponding page of our online presence, even if you do not have a profile or are not logged in at the time.

This information (including your IP address) is sent directly from your browser to a server of the respective provider (possibly in the USA) and stored there.

If you are logged into one of the services, the providers can directly assign the visit to our website to your profile in the respective social network. If you interact with the plugins, for example, by pressing the “Like” or “Share” button, the corresponding information is also transmitted directly to a server of the providers and stored there. The information is also published in the social network and shown to your contacts there.

This serves to safeguard our predominant legitimate interests in optimal marketing of our offer in accordance with Art. 6 para. 1 sentence 1 lit. f GDPR.

The purpose and scope of data collection and the further processing and use of the data by the providers as well as a contact option and your rights and settings options regarding the protection of your privacy can be found in the providers' privacy notices:

If you do not want the social networks to directly assign the data collected via our online presence to your profile in the respective service, you must log out of the respective service before visiting our website. You can also completely prevent the loading of the plugins with add-ons for your browser, e.g. with the script blocker “NoScript” (http://noscript.net/).

YouTube video plugins

This website integrates content from third parties. These contents are provided by Google LLC (“provider”). YouTube is operated by Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA (“Google”).

In the case of YouTube videos that are embedded on our site, the extended privacy setting is activated. This means that no information from website visitors is collected and stored by YouTube unless they play the video. The embedding of the videos serves to safeguard our predominant legitimate interests in optimal marketing of our offer in accordance with Art. 6 para. 1 sentence 1 lit. f GDPR.

The purpose and extent of data collection and the further processing and use of the data by the providers as well as your rights and settings options regarding the protection of your privacy can be found in Google’s privacy notices http://www.google.com/intl/en/+/policy/+1button.html.

Pinterest conversion tracking

This website uses the conversion tracking technology of the social network Pinterest (Pinterest Europe Ltd., Palmerston House, 2nd Floor, Fenian Street, Dublin 2, Ireland), which enables website visitors who have already shown interest in the website and its content/offers and are Pinterest members to see relevant ads and offers on Pinterest.

To do this, a so-called conversion tracking pixel from Pinterest is integrated on the pages, through which Pinterest is notified of your visit to the website of Primal State Performance GmbH and which parts of our offer you were interested in. For example, if you were interested in subscriptions on the website, you may see an ad for these subscriptions on Pinterest.

You can object to the collection of data for showing interest-based ads on Pinterest at any time in your account settings on Pinterest under  https://www.pinterest.de/settings (there under “Use information from our partners to better tailor recommendations and ads on Pinterest” deactivate the button) or under  https://help.pinterest.com/en/article/personalization-and-data#info-ad (there deactivate the checkbox under “Deactivate personalization”).

Right to object

Insofar as we process personal data as described above to safeguard our predominant legitimate interests, you may object to this processing with effect for the future. If the processing is for direct marketing purposes, you can exercise this right at any time as described above.

If the processing is for other purposes, your right to object is only available if there are reasons arising from your particular situation.

After exercising your right to object, we will not further process your personal data for these purposes unless we can demonstrate compelling legitimate grounds for the processing that override your interests, rights, and freedoms, or when the processing serves the assertion, exercise, or defense of legal claims.

This does not apply if the processing is for direct marketing purposes. In that case, we will not further process your personal data for this purpose.
